These terms govern purchases of paid Hyperoche software, including Phengos Pro. Free software is provided under its own licence and is not sold.
By completing a purchase, you agree to these terms and our Refund Policy.
EU consumers — your statutory rights
If you are a consumer in the European Union, you have statutory rights that these terms do not remove or restrict. These include a 14-day right of withdrawal for distance purchases.
Our paid software is digital content delivered immediately by means of a licence key. Please read Digital content and withdrawal below, as beginning the download or activation with your express consent may affect your right of withdrawal. Our voluntary Refund Policy is separate from, and additional to, your statutory rights.
Who you are buying from
The software is published by Gijo Mathew, trading as Hyperoche (registration in progress; see the Legal Notice).
Order processing
Hyperoche sells paid software through third-party stores and resellers. Each acts as merchant of record for its own sales: it is the legal seller for the transaction, accepts payment, issues your receipt, and collects and remits applicable taxes including EU VAT.
Phengos Pro is sold through itch.io. Hyperoche Restaurant ERP will be sold through our merchant of record once that is available. The seller applicable to your purchase, with its payment details, is shown on your receipt.
Each applies its own billing and returns procedures. Hyperoche remains the producer and publisher of the software wherever it is bought, and the software itself is identical regardless of where you buy it.
Because the store or payment provider holds your payment method, billing enquiries, invoices, and refunds are handled through that provider — we cannot return money we did not receive. What we can do is support your request with them. See our Refund Policy for how that works, including our voluntary 30-day guarantee.
The licence
A paid purchase grants you a personal, one-time, perpetual licence to use the purchased version of the software, in the edition purchased, on all supported platforms.
The licence may not be resold or sublicensed. The complete licence terms are provided with the application.
Price and payment
The price is shown at the point of sale. Prices may differ between stores, regions, currencies, and platforms.
Payment is processed using the methods supported by the store or payment provider, which also issues your receipt.
Delivery
The software is delivered digitally and no physical product is supplied. After payment you receive a download and a licence key.
How the key reaches you depends on the seller. On itch.io, it is issued from your purchase page once you request it. Activation instructions are provided with the download.
Digital content and withdrawal for EU consumers
Paid Hyperoche software is digital content supplied without a tangible medium.
If you are an EU consumer, you normally have 14 days in which to withdraw from a distance purchase. If you ask for delivery or activation to begin during that period and expressly acknowledge that your right of withdrawal ends once supply begins, that right ends when supply begins, as permitted by EU consumer law.
Our voluntary Refund Policy may still apply independently of this statutory right.
Support
The purchase price covers the software itself. It does not include personal or priority support.
Where a store directs a technical problem to us before processing a refund, we will respond and attempt to resolve it. That is part of standing behind what we sell, and is separate from any paid support arrangement.

Disputes and resolution
Billing and order disputes should first be raised with the store or payment provider that processed the transaction.
We are also willing to address consumer complaints directly and in good faith. Nothing in these terms affects your statutory consumer rights, including any right to bring a matter before a court or competent authority in your country of residence.
Changes to these terms
We may update these terms from time to time. The version in effect when you make a purchase applies to that purchase. The date at the top of this page identifies the latest revision.
