Privacy Policy

This policy covers the Hyperoche website (hyperoche.com), the Phengos website (phengos.hyperoche.com) and its documentation, and all Hyperoche software — currently Phengos and Hyperoche Restaurant ERP, and any application we release later. Together these are referred to as “our services.”

Hyperoche designs its software and services to collect as little personal data as practical. We do not sell your personal data.

Note. Hyperoche is being established as a registered company. Until registration is complete, the operator can be contacted by email using the details below. The registered legal name and address will be added when available. This policy should be reviewed by a suitably qualified professional for the relevant jurisdictions before it is relied upon. It is a starting draft, not legal advice.

Who we are

The services are operated by Hyperoche, an independent software studio whose registration is in progress.

For privacy enquiries, contact privacy@hyperoche.com. The operating company's legal name and registered address will be published here when registration is complete.

Our websites

This section applies to hyperoche.com, phengos.hyperoche.com, and the accompanying documentation.

The websites are static. They set no cookies, display no advertising, and use no third-party analytics or tracking scripts. Fonts and search operate locally in your browser and do not send information about your visit to a third party for tracking.

Processing still occurs at the hosting and network layer. The sites are served through Cloudflare, which processes technical request data such as IP addresses and may retain aggregate, non-identifying traffic counts and security logs. This processing is used to deliver the sites, maintain their availability, and protect them from abuse. It is based on our legitimate interest in operating secure, functioning websites.

We do not use this data to identify or profile visitors. Cloudflare processes it as our infrastructure provider. Please refer to Cloudflare's privacy documentation for information about its own handling of this data.

Contacting us

If you email us, we receive your email address and any information included in your message. We retain that correspondence for as long as necessary to answer your enquiry and handle any relevant follow-up. We do not use it for unrelated purposes.

Purchases and payment processing

Hyperoche does not process or store payment details. Every paid purchase is handled by a store or merchant of record, which acts independently as the seller for that transaction.

The store collects whatever it needs at checkout — typically your name, email address, billing details, and payment method — and its own privacy policy governs that processing. The store applicable to your purchase is named on your receipt.

Each store publishes its own privacy policy, and we recommend reading the one for the store you buy from.

The store passes Hyperoche only the limited information needed to issue and support your licence, such as an order reference and a delivery email address. We never receive your full payment-card details.

Hyperoche software

Our applications run on your own computer. They have no Hyperoche account, and there is no central database holding your work.

Common to all our software

  • Your working data — documents, records, projects, and files — stays on your device. We have no copy and no means of obtaining one.
  • Crash reports are sent only if you opt in. They contain technical diagnostic information such as the application version, operating system, and error details. They are designed to exclude your credentials and your content, and are not linked to your identity.
  • Update checks, where enabled, send the application version, platform, edition, package type, and a random installation ID generated on your device. That ID is not linked to your identity or your licence, and update checks never send your licence key.
  • Paid update downloads send your licence key to the Hyperoche download service, which verifies it and returns a short-lived storage link. The application then downloads from that link without attaching the key, so the key reaches only our own endpoint. We do not associate it with your identity. The only licence data we keep is a short revocation list of keys that have been deliberately disabled — following a refund or chargeback, for example. Free editions do not use a licence key.

AI features

Phengos, and AI-assisted features in our other software, work with your own provider account rather than ours.

  • API keys are stored in the secure credential store provided by your operating system, never in plain-text configuration. They are not transmitted to Hyperoche.
  • Prompts, responses, and files stay on your device unless you choose to send them to an AI provider. When you do, the selected data goes directly to the provider you picked, using your own key. We are not an intermediary and do not see it.
  • You choose what is shared. Files are never sent implicitly. What the provider receives is what you selected.
  • Local models. If you use a local model server instead, nothing leaves your machine at all.

Data sent to a provider is then subject to that provider's own terms and privacy policy.

Restaurant ERP and business software

Our business software runs entirely offline. Its records — including any personal data about your staff, customers, or suppliers — stay on your own hardware.

Hyperoche is not a processor of that data, because we never receive it. There is no synchronisation, no cloud backup, and no telemetry carrying business records. If you are a business subject to data protection law, this means your records remain wholly within your own control and your own compliance perimeter.

AI-assisted search in the ERP runs against a local model, so business data is not sent to an external provider.

Trials and sales enquiries

If you request a trial or contact us about a purchase, we receive the details you send — typically a name, an email address, and information about your business. We use it only to arrange the trial and answer your enquiry, and we retain it for as long as that remains relevant.

If an application feature processes information that may be personal data, that processing is disclosed in the application's documentation. Where required by law, the feature is controlled by an opt-in that you may decline or withdraw.

Your rights

Depending on where you live, you may have rights relating to personal data we hold about you. These may include the right to access or correct it, request its deletion, or object to certain processing.

Because our websites and software are designed to retain very little personal data, there may be little information on which to act. You can exercise any applicable rights by contacting privacy@hyperoche.com.

You may also have the right to complain to your local data protection authority.

Data retention

We retain personal data only for as long as there is a reason to keep it.

Email correspondence is retained while it remains relevant and is then deleted. Server and security logs are kept only for the short period needed to operate and protect the services. Opt-in crash reports are retained only for as long as they remain useful in diagnosing and correcting the underlying problem.

Children

Our services are not directed at children, and we do not knowingly collect personal data from them.

Changes to this policy

We may update this policy when our services change or when required by law. The date at the top of the page will be updated when revisions are made.
